Terms and Conditions

1.1 THE PROGRAMS AND PRODUCTS

All the meals within all the company’s online meal plans are pre-set and therefore new recipes will never be created upon request either in advance of receiving your updated phases (month) or during.

The set meals will be calculated and tailored in line with The Physique Geek LTD own algorithm. This algorithm is confidential to the business and will never be disclosed. By tailoring, our approach is to calculate the calories and macronutrients (carbohydrates, proteins and fats) for each meal and modify accordingly to reach the desired total for each client taking into account the information provided in the lifestyle questionnaire.

Our approach to calculating what we believe is optimum for each client is unique and by signing up to the company’s online program you are trusting this approach. Disagreeing with our methods on the basis of other professionals point of view will not result in any aspect of the program being re-designed or warrant a refund.

The training contained within the program is also pre-set. You will receive details on the exact structure to follow, meaning the exercises, duration, reps, sets and rest times. Due to strength being individual to each individual, weight on the workout programs section will never be specified and this is something you will have to discover through carrying out the exercises. The best results will come by following this and only this. Training is only permitted once a day and no more. Please ensure you complete your age, height and weight on the questionnaire. We need the lifestyle questionnaire completed thoroughly as well as clear body shot photos before a program can be booked in and created. The pictures will need to be taken in swimwear or equivalent so that body composition can be assessed. Once your chosen program begins you will be in complete control of the results. In order to achieve with this program you need to stick to it 100%, this includes, portions, meal timings, training, alcohol consumption and eating out all explained in your program. It is not the responsibility of the company to chase you for any information. You upload, through your own unique link sent to you, your updated weight and measurements as well as including up to date photos so that your body composition and progress can be assessed – this is the only way to submit results. It is only when the company receives all this information that the next phase can be designed and sent out to you within 2-3 working days.

1.2 LIABILITY / RISK

When following the company program you are doing so responsibly with your own guidance and take full responsibility for the effects on your body which you may experience along the way.

As with any exercise program you assume certain risks to your health and safety. Any form of exercise program can cause injuries, and any of the programs from The Physique Geek LTD is no exception.

It is possible that you may become injured doing the exercises in your program, especially if they are done with poor form. If you choose to participate in these risks, you do so of your own free will and accord, knowingly and voluntarily assuming all risks associated with such exercise activities. These risks also exist for those who are currently in good health right now.

Our company does not act as medical doctors. You MUST consult your doctor before beginning ANY of our programs or exercise programs, no exceptions. You MUST consult your doctor/physical therapist immediately in the event or illness or injury and follow their direct advice which could mean stopping the program altogether.  You are using the chosen program at your own risk and The Physique Geek Ltd is not responsible for any injuries or health problems you may experience or even death as a result of using The Physique Geek SMT Program.

The Physique Geek LTD holds all appropriate insurances with a reputable UK Insurer, we ensure our policy is renewed annually and details of our cover can be provided upon written request. Any and all potential claims need to be made in writing and a company representative will respond within 30 days.

1.3 DATA PROTECTION ACT 1998

The Physique Geek LTD may use your personal information to provide products and associated services you request to administer your account and to contact you for feedback on your use of such products and services. If you provide your email address when you register with us or buy from us, we will not send unsolicited marketing material to you. All information supplied will be held by The Physique Geek LTD and will remain secure and confidential. Your details will only be used for research purposes and will not be passed on to any third parties or used for marketing purposes in accordance with the Data Protection Act 1998.

The data will only be disclosed to employees of The Physique Geek LTD to enable them to produce your programs. The data will be kept securely for as long as you are our client.

1.4 PAYMENTS

By choosing to sign up to the 90 Day SMT program, you have chosen to pay for your program using our direct debit option please note that in doing so you have entered into a minimum 3 month contract with The Physique Geek Ltd. Each month, post the initial 3 months, you will continue to receive unlimited access to our support team, updated programs dependent on your new goals, and will continue to be billed for the time that you choose to remain a client. In order to cancel your subscription after 3 months, simply send an email to support@thephysiquegeek.com requesting cancellation of your membership and billing will stop.

If a payment is cancelled, cannot be taken due to insufficient funds, or has been refused by Stripe within the first 3 months, a reminder email will be sent to you requesting the outstanding payment. If the funds have not been received within 5 days of the due date, the payment will be requested again after 7 days. If this payment request fails, program production will go on hold until the balance is paid. In the event that we have not heard from you and payment isn’t successfully received within 5 working days after second request, a further email will be sent advising you that if outstanding funds are not received we reserve the right to pass your details over to our chosen debt collection agency to enable us to recover the costs. This email will represent the final demand for payment and will be in line with the statutory 30 days period in accordance with the UK Late Payment of Commercial Debts (Interest) Act 1998.

Please understand that by purchasing the program using the Direct Debit option you are entering into a 3 month payment contract with The Physique Geek LTD. Once you commit to this agreement payments cannot be cancelled until you reach the end of the 3 months.

Due to business structure and the way in which each phase has been designed for optimum results, repeating a phase is NOT permitted – other than in the event of proven injury (official medical document) or exceptional circumstances agreed by The Physique Geek Ltd.

1.5 REFUNDS

Since The Physique Geek LTD is offering non-tangible goods we do not issue refunds once the order is accomplished.

As a customer you are responsible for understanding this when purchasing any product from our site and in the unlikely event of the meals not being to your liking, taste or falling in line with personal circumstance be that lifestyle or financial, this would not warrant a refund.

However, we realise that exceptional circumstances can take place with regards to both the character of the product we supply and your personal life.

Therefore, we may honour requests for a refund for the following reasons:

  1. Product not-as-described and as detailed above in our terms and conditions: such issues should be reported within 3 days from the date the product is received. Clear evidence must be provided proving that the purchased product is not as it is described either on the website and or in our terms and conditions. Complaints which are based merely on the customer’s false expectations or wishes are not honoured.
  2. In the event of serious debilitating illness or injury. Confirmation of this in the form of a doctor’s note or medical certificate will need to be provided before consideration.
